Rules & Regulations

The following Rules and Regulations of the West Cliff Villas Homeowners Association (the Association) are based upon the Association's CC&R's, and are provided to you as a reminder of the provisions which must be followed by all homeowners and residents of the community.
 
  1. The use of the Units within the Properties is hereby restricted to Residential Use.  The number of permanent residents is a Unit is restricted to two (2) persons per bedroom plus two (2) additional residents for each Unit.  In accordance with the Association CC&R's, Section 10.01 (a), loft areas are not considered bedrooms. 
  2. No noxious, illegal, or seriously offensive activities shall be carried on upon any unit or common area, or in any part of the property, nor shall anything be done thereon which may be or might become a serious annoyance or nuisance to, or which might interfere with the quiet enjoyment of each of the owners of their respective unit or the common area, or which shall in any way increase the rate of insurance for the project, or cause any insurance policy to be canceled or to cause a refusal to renew the same, or which will impair the structural integrity of the building.
  3. Vehicles shall be parked in compliance with the West Cliff Villas Homeowners Association PARKING RULES & REGULATIONS (See attachment). 
  4. No signs shall be displayed to the public view on any unit or on any portion of the property except such signs as are approved by the Board of Directors.

    One (1) single "for sale", "for rent" or "for lease" sign may be allowed provided it does not exceed six square feet in size.  The foregoing sign may be displayed from the inside of the unit window only. 

    Additionally, one (1) "for sale", "for rent" or "for lease" sign may be posted in the space by either the Cowell Street or Bay Street gate, outside of the gated area. 

    Homeowners are encouraged to have their sales or rental agent contact the Association's Managing Agent at Shoreline Property Management at 831-426-8013 for additional information. 
  5. No more than one (1) usual or ordinary household pet may be kept, provided it is kept under reasonable control at all times.  No dog or animal shall enter the common area except while on a leash, which is held by a person capable of controlling the pet.  Owner's "walking" their dogs and all other animals in the common area must be prepared to clean up after their pet.  No dog whose barking disturbs other owners or residents shall be permitted to remain on the property.  Owners shall be fully responsible for any damage caused by their pets. 
  6. No personal items of any kind, including firewood, may be stored or placed in any part of the common area at any time.
  7. All rubbish, trash and garbage shall be regularly removed from the property and shall not be allowed to accumulate thereon.  All trash is to be placed inside the dumpster(s).  Cardboard boxes must be broken down (flattened) and recyclable items placed inside the appropriate receptacles.
  8. Any lease or rental agreement shall be required to be in writing and to provide that the term of the lease/rental shall be subject in all respects to the provisions of the CC&R's and Bylaws and to all house rules and regulations adopted by the Board of Directors and that any failure of the lessee to comply with the terms of such documents shall be a default under the lease or rental conditions. 
  9. All owners renting or leasing their units shall promptly notify the Managing Agent for the Association, in writing, of the names of all tenants and members of a tenant's family occupying the unit and of the address and telephone number where such owner can be reached. 
  10. Delivered newspapers are to be immediately removed from the common area not allowed to accumulate. 
  11. No building, fence, wall, obstruction, outside or exterior wiring, balcony, screen, patio, patio cover, tenant, awning, carport, improvement or structure of any kind shall be commenced, installed, erected, painted, repainted, or maintained upon the property, nor shall any alteration or improvement of any kind be made thereto unless the same has been approved in writing by the Architectural Control Committee and the Board of Directors, with respect to exterior changes. 
  12. No exterior clotheslines shall be erected or maintained and there shall be no outside laundering or drying of clothes and towels. 
  13. All drapes or window coverings visible from the street or common areas shall be white or off-white.  Off-white shades shall be approved by the Architectural Control Committee and Board of Directors.
  14. No major power equipment, hobby shops, or vehicle maintenance (other than emergency work) shall be operated on the property except when prior written permission of the Board of Directors.
  15. Garage doors must be kept closed at all times except when entering or exiting.
  16. Due to safety and visibility considerations, bicycle riding, skateboarding, rolling blading, and roller skating are not allowed within the common area. 
  17. Due to safety and visibility considerations, ball playing which includes basketball, football, volleyball, etc., will not be allowed in any area of the property except for the rear lawn area. 

    Should any damage be caused to the landscaping or any other area of the property, the costs for repair of the damage shall be the responsibility of the homeowner, as described in the following paragraph.
  18. The owner of each unit shall be liable to the Association for all damages to the common are, or improvements thereon, caused by such owner or any occupant or guest of their unit, except for that portion of said damage, if any, covered by insurance.  Liability of an owner shall be established only after notice to the owner and a Hearing before the Board of Directors.
  19. Planters or other objects are not be placed on balcony or fence railings on or above the second and third floor level.
  20. Individual yard/ garage sales are not allowed.
 
THE ASSOCIATION MAY IMPOSE FINES OR TAKE DISCIPLINARY ACTION AGAINST ANY OWNER FOR VIOLATIONS OR ANY PROVISION OF THE ASSOCIATION CC&R'S, BYLAWS AND/ OR RULES AND REGULATIONS PROVIDED THAT THE OWNER SAID TO BE IN VIOLATION IS GIVEN NOTICE AND THE OPPORTUNITY TO BE HEARD WITH RESPECT TO THE ALLEGED VIOLATION BEFORE A DECISION TO IMPOSE FINES OR DISCIPLINE IS MADE. 
 
VIOLATIONS OF THE ASSOCIATION CC&R'S, BYLAWS, AND/ OR RULES AND REGULATIONS SHOULD BE REPORTED TO THE MANAGING AGENT FOR THE ASSOCIATION.
